Counter-Notification

If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing our Designated Copyright Agent with the following information:

  1. Your physical or electronic signature;
  2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which ZapUpload may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

After receiving a valid counter-notice, we may restore the content unless the original claimant files a lawsuit within the legally defined timeframe.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, ZapUpload has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We maintain a "three-strike" policy:

  • First Strike: Upon receipt of a valid infringement notice, we will immediately disable access to the infringing material and notify the user.
  • Second Strike: A second valid notice will result in temporary account suspension and requirement for the user to certify removal of all infringing material.
  • Third Strike: A third valid notice will result in permanent account termination without refund.

ZapUpload may also at its sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Notice to Users

Copyright infringement is a serious offense that can result in:

  • Immediate removal of infringing content;
  • Account suspension or termination;
  • Legal liability under copyright law;
  • Potential criminal prosecution in severe cases.

Users are strongly advised to only upload content they own or have explicit permission to share.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims.
